  • This Terms of Service Agreement (“Agreement”) governs your use of the RoadCheck website located at https://road-check.com/ (“Site”). This Agreement, together with our Privacy Policy, forms a binding contract between you (“User”) and RoadCheck (“Provider”, “we”, “us”, or “our”).
  • This Site is operated by ROAD CHECK CORP., a company registered under the laws of the State of Florida, with principal offices at 7950 NW 53 Street Office 337 DORAL FL, 33166 USA, along with its affiliates.
  • Please read this Agreement carefully before using the Site. By accessing or using the Site in any manner, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree to all terms and conditions outlined herein, you must not use the Site.

Acceptance of Agreement

  • This Agreement between you and RoadCheck governs your use of the Site, including all content and features. Each time you access or use the Site, you signify your acceptance of this Agreement and agreement to comply with all applicable laws and regulations. By accessing the Site, you represent and warrant that you are at least eighteen years old and possess the legal authority to enter into this Agreement. If you do not meet these requirements or disagree with any terms, you may not use the Site.

Scope and Authority

  • These Terms of Service apply exclusively to your activities when using the Site or its contents. RoadCheck may establish branded services operating under different terms, which will be linked from those services’ home pages. These Terms do not affect or amend any other contracts you may have with RoadCheck or its affiliates, such as carrier contracts or service agreements.
  • RoadCheck provides services primarily for persons located in the United States and makes no claims that the Site or its content is accessible or appropriate outside the United States. Access from outside the U.S. is at your own initiative, and we cannot guarantee compliance with local laws.

Privacy Policy

  • Our Privacy Policy, accessible at https://road-check.com/privacy-policy/, explains our practices regarding collection, use, storage, and disclosure of personal information. By using our Site and providing personal data, you consent to our Privacy Policy.

Intellectual Property Rights

  • RoadCheck, its affiliates, and/or licensors own all Site content, features, functionality, and systems, including all copyrights, trademarks, and other intellectual property rights. All Site content, including text, displays, images, video, audio, design, data, software, code, and other materials are protected by U.S. and international intellectual property laws. Acceptable Use

  • You are responsible for all activities conducted through your use of the Site and agree to use the Site in accordance with this Agreement and all applicable laws. Prohibited activities include unauthorized access, data scraping, reverse engineering, disrupting Site functionality, and any activity that may harm the Site or its users. Violations may result in termination of access and reporting to law enforcement authorities.

  • RoadCheck respects intellectual property rights and will investigate proper notices of copyright infringement. To file a infringement notice, provide our Copyright Agent at info@road-check.com with your contact information, identification of the copyrighted work, description of the infringing material, a statement of good faith belief of unauthorized use, a verification statement, and your signature.

Disclaimer and Liability

  • Your use of the Site and any services obtained through it is at your own risk. The Site is provided “as is” without warranties of any kind. RoadCheck disclaims all warranties to the fullest extent permitted by law. RoadCheck shall not be liable for any damages arising from Site use, with liability limited to the lesser of amounts paid to RoadCheck or $100. You release RoadCheck from all claims related to Site use and agree to indemnify RoadCheck against liabilities arising from your use or breach of this Agreement.

Termination

  • RoadCheck may terminate, suspend, or limit your Site access without notice or liability at any time. Termination does not affect your obligations or RoadCheck’s rights under this Agreement.

Governing Law

  • This Agreement and your Site use are governed by Delaware law without regard to conflicts principles. Disputes shall be brought exclusively in Delaware courts, and you waive objections to venue.

General Provisions

  • RoadCheck’s failure to enforce any provision does not waive it. If any provision is invalid, the remaining provisions remain in effect. Claims must be filed within thirty days of accrual or be permanently barred.

Communications

  • By using the Site, you consent to electronic communications from RoadCheck. Notices under this Agreement shall be in writing and sent by email, text, or notifications. All communications should be sent to info@road-check.com.

SMS Communications

  • Phone numbers collected for SMS communications are not shared for marketing purposes. Message frequency may vary, potentially up to 100 messages weekly. Standard message and data rates may apply. You may opt in verbally, online, or by email. Reply “STOP” to opt out or “HELP” for assistance. Message types include load offers, confirmations, special instructions, and status inquiries.
